These Terms of Service (“Terms”) govern your use of the RunIt mobile application (the “App”) operated by Ross Labs (“we,” “us,” or “our”). By creating an account or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use RunIt. If you are between 13 and 17, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.
2. Your Account
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information during registration and keep your profile information current.
- You may not create multiple accounts, impersonate another person, or transfer your account to anyone else.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable Use
When using RunIt, you agree to:
- Treat other players with respect and good sportsmanship.
- Provide honest and fair ratings and reports about other players.
- Submit accurate crowd reports and venue information.
- Follow the rules and norms of any basketball court or facility you visit.
You agree not to:
- Harass, bully, threaten, or intimidate other users, whether in the App or at physical locations.
- Submit false or malicious ratings, sportsmanship reports, or crowd reports.
- Manipulate the rating, credibility, or reputation systems.
- Create fake accounts or coordinate with others to artificially inflate or deflate ratings.
- Upload content that is violent, sexually explicit, hateful, or otherwise inappropriate.
- Use the App for any illegal purpose.
- Attempt to access another user’s account or circumvent security measures.
- Reverse-engineer, decompile, or tamper with the App.
- Use automated tools, bots, or scripts to interact with the App.
4. Sportsmanship and Moderation
RunIt includes a community-driven rating and moderation system:
- Player ratings: After attending a run, you may rate other players on skill and sportsmanship. Ratings are anonymous and contribute to each player’s overall score.
- Sportsmanship reports: You may report unsportsmanlike behavior. Reports are reviewed and may result in credibility adjustments or account actions.
- Credibility score: Your credibility score reflects the community’s trust in you. It is affected by your behavior, reports, and moderation outcomes.
- Content moderation: We may review and remove content (including highlights, announcements, and reports) that violates these Terms.
- Account actions: We reserve the right to warn, suspend, or permanently ban users who violate community standards, at our sole discretion.
Moderation decisions are final. Repeatedly filing false reports is itself a violation of these Terms.
5. User-Generated Content
You retain ownership of content you create and upload to RunIt (including highlight videos, profile photos, and announcements). By posting content to the App, you grant us a non-exclusive, worldwide, royalty-free license to:
- Display, distribute, and make your content available to other users within the App.
- Generate thumbnails and compressed versions of your videos for performance purposes.
- Use your content to promote RunIt (e.g., featuring highlights in marketing materials), unless you opt out by contacting us.
You are solely responsible for the content you upload. You represent that you have the right to share any content you post and that it does not infringe on anyone else’s rights.
We may remove any content that violates these Terms without prior notice.
6. Location and Venues
- RunIt displays basketball courts and venues based on publicly available information and user submissions. We do not own, operate, or manage any physical court or venue.
- We make no guarantees about the availability, condition, safety, or suitability of any venue shown in the App.
- You are responsible for your own safety when traveling to and playing at any location. Always use your own judgment.
- Venue check-in and check-out features are for community coordination purposes. They do not grant you any right to access private property.
- By enabling background location and geofencing, you consent to the App monitoring your proximity to registered venues for automatic check-in/check-out functionality.
7. Rewards and Virtual Items
- RunIt includes gamification features such as experience points (XP), levels, quests, daily spins, tokens, and raffle entries.
- These virtual items have no monetary value and cannot be exchanged for cash, goods, or services.
- We reserve the right to modify, reset, or discontinue any reward system at any time without compensation.
- Abuse of reward systems (including exploiting bugs or using automated tools) may result in account suspension.
8. Intellectual Property
- The RunIt App, including its design, code, graphics, logos, and trademarks, is owned by us and protected by intellectual property laws.
- You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
- The RunIt name, logo, and associated branding are our trademarks. You may not use them without permission.
9. Account Deletion
- You may delete your account at any time through Settings > Delete Account in the App.
- Account deletion is permanent and irreversible. All your data, including your profile, ratings, highlights, stats, history, and rewards, will be permanently removed.
- Ratings you have given to other players will be anonymized but not removed, as they are part of the community record.
10. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The App will be available at all times or free from errors.
- Player ratings, crowd reports, or other user-submitted information are accurate.
- Any venue is safe, accessible, or suitable for basketball.
- The App will meet your specific expectations.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury or property damage arising from your use of venues found through the App.
- Loss of data, profits, or goodwill.
- Disputes between users, whether online or at physical locations.
- Actions taken by other users, including inaccurate ratings or false reports.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim (which, as a free app, is $0).
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App.
- Your violation of these Terms.
- Your violation of any third party’s rights.
- Content you upload or submit through the App.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.
If you do not agree with the updated Terms, you must stop using the App and delete your account.
14. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of California.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
